End User License Agreement

This End User License Agreement governs your installation and use of Cassava, software distributed by Apsis Labs.

Please read this End User License Agreement (the “Agreement”) carefully. By downloading, installing, or using Cassava, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not install or use Cassava.

1. License grant

Subject to your compliance with this Agreement, Apsis Labs grants you a limited, non-exclusive, non-transferable license to install and use Cassava. Cassava is licensed, not sold. Apsis Labs and its licensors retain all rights not expressly granted in this Agreement.

2. Installation and use

Licenses are per user. You may use your license on multiple computers where you are the primary user. Businesses and organizations must purchase enough licenses for the number of people using Cassava.

3. Beta licenses

Beta licenses purchased during the beta period do not expire. After the beta period, new licenses may be offered at a higher price or with a fixed update term. Your beta license remains valid according to the terms in effect when purchased.

4. Backup copies

You may make reasonable backup copies of Cassava and your license information for archival or recovery purposes.

5. Restrictions

You may not remove, obscure, or alter copyright notices, trademark notices, or other proprietary notices included with Cassava.

You may not sell, sublicense, share, publish, or distribute license keys. You may not redistribute Cassava except where Apsis Labs has expressly permitted redistribution in writing.

You may not rent, lease, lend, commercially host, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of Cassava, except to the extent such restriction is prohibited by applicable law.

6. Updates and support

Apsis Labs may provide updates, fixes, beta releases, or support at its discretion. Access to updates may depend on your license type and purchase date. Support is provided as available and is not guaranteed unless separately agreed in writing.

7. Disclaimer of warranty

Cassava is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. You are responsible for backing up your data and verifying results before relying on them.

8. Limitation of liability

To the maximum extent permitted by law, Apsis Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business opportunities, or goodwill arising from or related to your use of Cassava.

9. Termination

This Agreement terminates automatically if you violate its terms. Upon termination, you must stop using Cassava and delete any license keys in your possession. Sections that by their nature should survive termination will survive, including ownership, restrictions, warranty disclaimers, limitations of liability, and contact provisions.

10. Changes to this Agreement

Apsis Labs may update this Agreement from time to time. Any changes will be posted on this page, and the “Last updated” date will reflect the latest version. Continued use of Cassava after changes become effective means you accept the updated Agreement.
